Written Oct 29, 1918
I, W.H. PHILLIPS of Shirley, in the State of Arkansas, being of sound and disposing mind and memory , do make, ordain publish and declare this to be my last will and testament, hereby canceling and revoking any and all former wills by me made.
Article I. I direct that my funeral expenses and any just debts that I may owe at the time of my death first be paid out of any moneys or any property, real or personal. That I may have or own at the time of my deathW.H. Phillips
Article 2. there being no children born of our marriage, I give, devise, and bequeath to my beloved wife, NELLIE PHILLIPS, absolutely and in fee simple, all moneys, real property, personal and mixed property that I know own and all that I shall own at the time of my death, regardless of where said property shall be located.
Article 3. I name constitute and appoint my said wife NELLIE PHILLIPS as the executrix of this my last will and testament and request that she be allowed to serve with out bond.
In witness whereof I have hereunto signed my name in the Town of Clinton, Arkansas, on this the 29th of October 1918, in the presence of the witnesses whose names are signed at the end of this will, which said witnesses have signed and attested this will at my request.
We the undersigned hereby certify and attest that on the 29th day of October 1918, W.H. PHILLIPS of Shirley Arkansas. The above named testator was of sound and disposing mind and memory, that he signed the foregoing instrument in our presence and declared the same to be his last will and testament and request and we, at his request and in his presents and in the presents of each other have hereunto signed our names as subscribing and attesting witnesses.

Deposition of GARNER FRASER
Comes GARNER FRASER and oath says:
That he is one of the subscribing witnesses to the annexed last will and testament of W.H. PHILLIPS now deceased.
That on the 29th day of October 1918, he said W.H. PHILLIPS of Shirley, Arkansas, was of sound and disposing mind and memory; that he signed the annexed instrument in the presence of G.W. OWENS and the affiant and declared said instrument to be his last will and testament; and that the said G.W. Owens and the affiant at the ? of the testator, W.H. PHILLIPS and in his presence and in the presence of each other, signed our names as subscribed and attesting witnesses to said witnesses. G.W. OWENS, is now deceased.
