Deed from James C. Risner of Van Buren Co. to J.A. Pearson of Cleburne Co.
For and in consideration of the sum of Ten Dollars to me in hand paid by J.A. Pearson of Cleburne County Arkansas and for the other considerations and purposes herein after mentioned I James C. Risener of Van Buren County in the State afore said have this day granted, bargained and sold and by these instruments do grant, bargain and sell unto said J.A. Pearson his heirs and assigns as Trustee the following described Real Estate lying and being situated in said county of Van Buren and described as follows.
Viz: The South West fourth 1/4 of the So East fourth 1/4 and the North West fourth of the South East fourth of section Thirty Two (32) Township Ten (10) North of Range Twelve (12) West. Also my entire crops of cotton, corn and all other agricultural products raised by myself or any hands I may pay during the year 1886 on lands belonging to myself in the County of Van Buren or any where else I may be interested in such product during the year of 1886. To have and to hold the assign unto heirs the said J.A. Pearson his heirs successors and all from: But this conveyance is upon Turst for the following purposes and for none other whatever. I am in debited to Moore and Rollow of Quitman, Arkansas in the sum of Thirty Two and 78/100 Dollars for goods purchased to this date and in consideration of this Security they have agreed to sell me goods to the first day of October 1886 to an amount not to exceed the sum of Fifty dollars. Now if I shall on or before the said first day of October 1886 pay unto the said Moore & Rollow the said sum of Thirty Two and 78/100 Dollars and whatever further sum I may then owe them for goods, wares and merchandise I may hereafter purchase from them and also the expense of settling this trust then this conveyance shall be void.
But if I shall fail to pay the indebtedness and expenses above ??? on on by said first day of October 1886 Then said J.A. Pearson or any agents by him appointed may at any time there after take charge of said property and afterfirst having given notice of the time, ??? and place of sale, Sell said property at Quitman, Arkansas or on the premises to the highest bidder for cash and apply the proceeds of sale first to the payment of Expenses of Executing this ????: Second to the indebtedness above provided for and the balance of any Shall be paid over to said J.C. Risner or heirs. Said notices may be given by publication in any publication in any newspaper then published in said county or by other written or painted notices posted in the Township in which said Sale may be made: It is further agreed that said Moore & Rollow may stop the sale of goods to me at anytime if they deem it to their safety necessary and this conveyance in that court shall be a security for what I shall have purchased and may owe them: It is further agreed that if I may default and refuse to deliver said property on demand I will pay the attorneys fees agreed to be paid by said Moore and Rollow in case suit is brought for the same and said fac... be dedicated out of the proceeds of said sale and I hereby waive all right of appraisement as provided by ... of ca... shall ... made and said Moore and Rollow on any one for them may bid at said sale if they deem fit and their purchase shall be as valid as that of any other person and I C.J. Risner wife of the said J.C. Risner for and in consideration of the above sum of money and the promises aforesaid do hereby freely and ... release and relinquish unto the said J. A. Pearson and to ... purchaser at said sale all of my right of dower in and to the above granted Real Estate.
