I, William H. Smith, a resident of Muhlenberg County, Kentucky state that I was Lieutenant of Company I of the 11th Regiment of Kentucky Vol. Inft. and was personally acquainted with James A. Stinson a pri. of said Co. and Regt. That said Regt. left Battle Creek Tennessee on the 20th of August 1862. That said Stinson was sent off on the 19th in an ambulance to Stevenson Alabama he was very ill at the time with Jaundice and probably of fever of some sort so low indeed that in the opinion of the affiant it was impossible to recover or to survive more than a few days. The 11th Ky. and the whole army came on to Kentucky and said Stinson has never made his appearance but was missing from his Regiment and was reported on the Records of said Company as dead and affiant has no doubt whatever that he did die & in the line of his duty & in said service. Affiant knows of no one now living that has more knowledge on the subject than himself. There was but one other man belonging to his Regiment that was sent off with him to wit John A. Adcock who was also sick and died or was reported dead and has never made his appearance again. The said Stinson was reported as having died on the 20th of August 1862. His recollection is that the report of his death was made by some citizen whose name he does not know. Therefore from his knowledge of the condition and from the [illegible] sheets he has been missing from that time till now. [illegible] from his information and the report of his death, he has no doubt whatever thereof. The [illegible] by whom [illegible] was in the care of has duly [illegible] his information and belief is that the country about Stevenson was abandoned to the rebels when Buell's army left for Ky.

On this the 13th day of July 1867 before me Clerk of the County Court in and for the County and State above named personally appeared John H. Stinson a resident of Muhlenberg County Ky. who being duly sworn according to Law declares that he was personally acquainted with James A. Stinson late a Private of Co. I of the 11th Regiment Ky. Inft. for he was affiants brother. Affiant was a Private of Co. B of the same Regiment. That a few days before the Federal army under Gen. Buell marched from battle Creek in pursuit of Gen. Bragg to wit about the 15th or 20th of August 1862 to the best of his recollection. The sick and disabled of said army under Gen. Buell were sent to Bridgeport for the purpose of being sent to Huntsville Alabama so that the army in the march would not be encumbered with the sick. Among the names of the sick was the said James A. Stinson who was very low with Jaundice but the day they were all first sent the train did arrive from Huntsville for them and the men that were in a condition to be brought back to camp were brought back to await the next days train and all that were sent were brought back except said Stinson and John Adcock and I never seen or heard of my brother James A. Stinson afterward. I assisted in putting him in the ambulance when he was starting to Bridgeport and he was in a dieing condition and could not in my opinion have survived more than a day or two. I was at Bridgeport a few days afterwards but could not see or hear of him and he has never returned to his home and I have no doubt died at or near Bridgeport about the 20 of August 1862 in the line of duty & in said service. I know of no person in the [word] or present that knows as much of the circumstances of his death as I do. When I lifted him into the ambulance he said to me we'll never meet again in this world, that he could not live more than two or three hours. I am in no way interested in said claim.
