Will of W. R. Duncan
The state of Arkansas County of Bradley October 25th 1860
The last will and testament of William R. Duncan. First I will
and bequeath my spirit to God, who gave it, and my body to the earth
from whence it came, secondly, that all my honest debts be paid and
then, I will that Jane M, my wife have sixty acres of land where
the dwelling stands, and to each of my children Mary M. and James S.,
have sixty acres of land each and that Jane M their mother and my
wife have full control thereof until they are of full age and should
she find it to be to their interest to sell said land she can do so
during her widowhood and if she should marry I will for my children
not to pay any board while on said land, and I will that all my
personal property be sold and a good house obtained for my wife.
What comes there is on hand is for the use of the family not to be
sold. And it is my will that Jane M. Duncan, my wife and John G.
Martin carry this my last will into effect and I do hereby so
appoint them witness

Before the Clerk in vacation Nov. 19th 1860
Before me W. Y. McCammon clerk of the circuit court and exofficio
clerk of the court of probate personally appeared W. G. Maloney
subscribing witness to the above and foregoing instrument of writing
who being by me sworn according to law deposes and says in relation
thereto 1st that the same was subscribed by the tesator. 2nd in
the presence of the said, W. G. Maloney and James D. Payton, James
T. Robinson each of the attesting witnesses, 3rd the testator at
the time of making such subscription, declared the instrument so
subscribed to be his will and testament . 4th the attesting
witnesses thereto three in number signed their names at the end
of the will at the request of the testator, who was at the time
of amking his will of sound mind and memory.

County of Bradley} Before me W. Y. McCammon Clerk of the Circuit
Court and exofficio clerk of probate personally came and appeared
James T. Robinson who being by me sworn according to law deposes
and says in relation to the above and foregoing instrument read
in his presence and hearing, that the same was subscribed by the
testator in the presence of the witnesses W. G. Maloney, James T.
Robinson and H. D. Payton whose names are subscribed thereto and
in the presence of each other, and that the testator at the time
of making such subscription declared the instrument so subscribed
to be his will and testament and the attesting witnesses thereto
signed their names at the request of the testator who was at the
time of sound mind and memory .

County of Bradley} Be it remembered that on the 19th day of
Nov. 1860 the annexed and foregoing instrument as the last
will of W. R. Duncan was presented to me by the executors
therein named and at the same time came W. G. Maloney, and
James T. Robinson, who swore to and subscribed the foregoing
affidavits, being satisfied with the proof of said will, I
orderd the will and proof of Record......
