Will of John McDadeWill of John McDade Know all men that I, John McDade of the County of Bradley in the State of Arkansas being of sound and disposing mind and memory and calling to mind the uncertainty of life and the certain of death and wishing to dispose of my estate while I have mind and strength sufficient therefor do make ordain publish and declare to be my last will and testament hereby revoling all last wills and testaments by me at any time heretofore made. Item First I do hereby nominate and appoint my beloved wife Nancy McDade Executor of this my last will and testament . Item 2nd I do hereby give devise and bequeath to my beloved wife the said Nancy McDade all of the property real, personal and mixed of which I may die seized and possessed during her natural life or widowhood and at her death all of the above named property to be equally divided between my children. Item 3rd I desire that my wife shall collect and pay all of my just debtors and if necessary sell any property either at private or publick sale in order to enable to do so. Item 4th It is my will that the probate court shall not require of my wife to give bond in order to execute this my last will. In testimony whereof I have hereunto set my hand and seal this the tenth day of January Eighteen hundred and sixty five Attest A. C. Jones W. M. Van John McDade {seal} Before the clerk in vacation January 16, 1865 Canus (or Cames) Nancy McDade Executor of the last will and testament of John McDade deceased and presents for probation a paper purporting to be the last will and testament of John McDade and also comes A. C. Jones and Wm. M. Van whose signatures appear to the foregoing instrument, who each being by me duly sworn, do each depose and say, that the above paper, is the identical instrument signed by John McDade in our presence, and that he did sign, seal publish and declare it to be his last will and testament, in our presence, and in the presence of each other we did each sign our names as witnesses thereto and that the said John McDade was of sound disposing mind and memory at the time he executed his said last will and testament. In testimony whereof I, Wm. G. Wiess, clerk of the circuit court and exofficio clerk of the court of probate have hereunto set my hand and affix my official seal at office in Warren, County of Bradley State of Arkansas this 16th day January A D 1865.
