Will of Alfred Nelson

In the name of God Amen: I Alfred Nelson of the County and State aforesaid, being of sound mind and memory, and considering the uncertainty of this frail and transitory life, do therefore make, ordain, publish and declare this to be my last will and Testament. That is to say first after all my lawful debts are paid and discharged, the residue of my estate Real and Personal I give, bequeath and dispose of as follows, to wit.

All of my household & kitchen furniture to my daughter Isabell, also one Bay poney mare also all of my hogs but three which three only son William is to have, also one cow and calf, one yearling, all of the above named property to my daughter Isabell, with the exception of the three named hogs to my son William,

I also bequeath to my daughter Margaret one mare poney of a yellow color, also one cow and calf, one mule colt to my daughter Matilda, one old wagon and all my farming utensils I bequeath to my son William.

I want my farm that I now live on and all the lands that I have to be sold at my death, the proceeds to be equally divided between my lawful heirs with this exception. I want my son William to have twenty dollars more than the remainder of my children each child having share and share alike. Likewise I make constitute and appoint my sons William and Newton to be my executors of this my last will and testament, hereby revoking all former wills by me made.

In witness hereof I have hereunto subscribed my name and affixed my seal this the 22nd day of June A. D. 1872.

The above written instrument was subscribed by the said Alfred Nelson in our presence and acknowledged by him to each of us, and he at the same time published and the above instrument so subscribed to be his last will and testament and we at the testator's request and in his presence have signed our names as witnesses hereto and written opposite our names our respective places of residence.

Personally appeared before me __ B. Crump County and ex officio Probate Clerk of said County. F. G. Wilburn and W. A. Lowrey who being duly sworn say that Alfred Nelson (now deceased) subscribed the foregoing will in the presence of each of the deponents who are subscribing witnesses to said will and that the said Alfred Nelson declared the instrument so subscribed to be his last will and testament and that we signed our hands thereto at the request of the testator.

To all Persons to whom these Presents shall come Greeting. Know ye that the last will of Alfred Nelson deceased hath in due form of law been exhibited proved and recorded in the office of the County Clerk for Boone County, a copy of which is hereto annexed, and in as much as it appears that William Nelson & Newton Nelson has been appointed Executors in and by the said last will to execute the same, and to the end that the property of the testator may be preserved for those who shall appear to have a legal right or interest therein. and that the said last will may be executed according to the request of the testator, we do hereby authorize them the said William Nelson & Newton Nelson as such Executor to collect and secure all and singular the goods and chattels, rights and credits, which were of the said Alfred Nelson at the time of his death in whosoevers possession the same may be found, and to perform and fulfill all such duties as may be enjoined upon them by said will, so far as there shall be property, and the law charges them and in general to do and perform all other things which now are, or here afar may, require of them by law.

In testimony where of, I __ B. Crump, Clerk of the Probate Court in the aforesaid county of Boone have hereunto signed my name and affixed the seal of said court at office in Harrison this 10th day of August, A. D. 1872
