There is a man named HENRY DONAHOO on the 1803 Claiborne Co. TN Tax List, but it is yet unknown if this is HENRY DUNEHEW of the 1850 IZARD CO. AR. Census. We also
see that a name of HENRY DUNEHEWE is listed on the 1840 GRAINGER CO. TN Census. Below are these listings so that others may do further research to see if it can be verified this is HENRY DUNEHEW of the 1850 IZARD CO. AR Census :

Some have listed HENRY DUNEHEW as father of WILLIAM C. DUNEHEW and it would seem possible as they were neighbors in Izard Co. AR on the 1850 census. Per some, William C. Dunehew was born to Henry Dunehew and Unknown spouse in 1816 Hickman Co. TN. Hickman Co. TN, Humphries Co. TN and Stewart Co. TN are in the middle of the state of TN. Per most listing Henry Dunehew, they have stated he was born either in Tennessee or Arkansas. I would think Tennessee or possibly even a state further east would be where Henry Dunehew was born in 1780 but have no verifications for him. The DONAHO / DONAHOO name is prevalent in the Pee Dee River area of NC and SC. The CATHEY name is also prevalent in that same SC region, and later we find that the CATHEY family has living in their household a young INMAN DUNEHEW who is regarded as the grandson of HENRY DUNEHEW in Izard Co. AR. ARCH CATHEY is listed as age 60 born in Georgia in the 1860 Izard Co. AR census. We know that many of the North Carolina families moved to Georgia with our own Spencer A. McAfee being one such family member born perhaps in NC who later moved with his family as a child to Georgia. Some listed Spencer A. McAfee born in GA as well, and in time we hope to prove he was born in NC and moved to GA. Later on Spencer A. McAfee moved to AR and married 3'rd wife, SURELDA JANE DUNEHEW the granddaughter of Henry Dunehew. Surilda / Sarelda Jane Dunehew was the daughter of William C. Dunehew and wife Mary A. Herrell or Howell.

The Henry Dunehew of Miller Missouri census, is considered not to be our Henry Dunehew of the Izard Co. AR Census.

"Just here I will state that there were only two companies of McCarver's Regiment with us at that time, the other four companies having left for Bowling Green, KY, sometime before my enlistment. These companies were commanded by Captains Elkins, Wolf, Matheney, Airington, Shinpock, and Nunn. Several of the soldiers died while here, mostly from Measles, among whom were Davids Bone, Joel Battles, INMAN DONAHOO and Joe Miller. Sergeant Sam Taylor, while in a play with John Strother, accidntally broke his leg and was sent home. Capt. Elkins was sick and sent home at the same time and never came back to us. "

per info on internet on ARCHIBALD CATHEY was born 25 Aug. 1799 in GA. He died Oct. 8, 1870 TN, and is buried in the Hill Orchard Cem. Houston Co. TN. ( could be two different Arch Cathey's ? or he may have returned to TN. from AR. ?? ) Some of the Cathey family had also been in Stewart Co. TN. Per other genealogies on CATHEY lines the surname is Scotch-Irish origin tracing back to the Lowlands of Scotland in the 17th Century. They were members of ancient clan of MACFIE and within that clan were names of MacPhee, Duffy, MacDuffy, McAfie, McFee, Mahaffey, McGuffey, MacCathie, Cathey. Catheys were thought to have been from GALLOWAY in the Scottish Lowlands and were early settlers in Ulster in the 17th Century. Some of the line arrived in Cecil Co. MD with the name of JOHN CATHEY b. 1685 Ulster Ireland. he arrived between 1746-1751 and they moved from MD into Lancaster Co. PA in early 1730's. By 1743 the Cathey name is found in Beverly Manor in Augusta Co. VA. JAMES CATHEY had migrated to ANSON CO. NC by late 1740s'. That land became ROWAN CO. NC by 1753. The Cathey Settlement or IRISH SETTLEMENT was located west of Salisbury NC and where James Cathey was in 1749. His sons moved into Mecklenburg Co. and Haywood Co. NC by late 1700's. Archibald Cathey is the only one of his siblings to have been listed born in GA. His father, Andrew Cathey was born in abt. 1721 PA and his sister, Rebecca G. Cathey b. 15 Sept. 1792 in NC. By 1799, Archibald Cathey is listed being born in GA.

They spelled their name Donahoo.Donaho and several other ways back then. I have a William Dunhew b. 1816 TN. He was in Indiana in 1835 and had several children in Indiana before moving on to Arkansas in 1850 and to MO in 1860. The childrens names are : Parmelia, Parazada, Surilda, Martha, John, Manerva, Louisa, William, Mary Polly and Jasper.

AR was issued Land Patent Certificate No. 10, 230 on 1 July, 1859 for "the West fractional half of the North West fractional quarter, of Section thirty six, in Township seventeen North, of Range seven West in the District of Lands subject to sale at Batesville Arkansas, containing eighty five acres, and nine hundredths of an acre."

Per this same record William C. Dunehew married Mary A. Herrell, or Howell b. 1818 in TN. Some have listed William C. Dunehew born in Hickman Co. TN, but I have not seen verifications for that. William C. Dunehew is also listed with second wife, Nancy Ann Passmore b. 1816 and that they married after 1856. William C. Dunehew is then listed with 3rd wife, Sarah A. Clark b. 1828 IL, per this same record file. The child listed as SURELDA J. DUNEHEW b. 1838 IN is my GGG Grandmother, Surilda Jane Dunehew McAFee who md. AR Census; however, I include this notation that further research may prove a connection and that some connection existed between the CATHEY family and the DUNHEW/ DONAHEW families of Izard Co. AR that we are yet to discover. :

Per photo owned by my mother, Elsie B. Davidson and now in my possession, showing Spencer Alvin McAfee and Surilda Jane Dunehew who were Great Grandparents of Elsie B. Davidson Rogers, and from the oral history Elsie told me about them, it appears that Surilda Jane Dunehew McAfee may have been Native American as many have said of her family. " We have no verifications to prove this however. " Family oral history is in most all the lines of DUNEHEW / DONNAHOU / DONAHOO family who have the same oral history of the Dunehew family being Cherokee or Native American and were from Indiana into Arkansas. Elsie was aware that the Dunehew line also was living in Missouri and had researched various court houses to find more information on Dunehews and McAfee family. - Tina Rogers Beller, Aug. 12, 2004.

The family moved to Habersham County, Georgia in 1840, then to Cherokee County, Georgia in 1850. These counties are proximal to Rutherford County, North Carolina. The 1850 Census lists Elzira as the head of household. His father is speculated to be John S. McAfee. Spencer lists John as his father in a census, and in a bible record. Spencer is listed as the only landowner of the family in the 1850 Walker County, Georgia, 1850 Census. He is listed twice in the 1850 census, ( Cherokee County, also. ). In Walker County, Spencer was living with his brother, Berry and his wife, Nancy. they had two children: William Washington McAfee and Louise E. McAfee, ( same William W. in Newton County, Arkansas. The father was not present in 1850 on and either died or left the family. ) Spencer was located in Fulton County, Arkansas in 01 OCT 1856 with his first wife, Eveline, nee Sparks. She died 7 months after this marriage date and was buried on the North Fork of the White River in Fulton County, ( Sparks Cemetery. ) Several other members of the family moved into Arkansas from Georgia about the same time. his brother, Berry was in Newton County during the 1860's. Spencer maried his second wife, Hannah Adeline Lance, ( 1828, Tennessee, ) on 15 SEP 1859. He called her "Hanner." She bore two sons:

Hannah had barely time to recover from the birth of twins, the death of one,
Samuel Hannah McAfee died of fever, that she endured escape to Missouri with the onset of the Civil War. along with several families, including his brother, John, his brother in law, Frank Lance, and other Franks brother, Spencer joined Company G, Phelps Regiment, Missouri Mounted Infantry, on 15 DEC 1861, in Rolla, Missouri. Spencer left the unit at the time of Hannah's death, Rolla, Missouri, due to measles, 03 DEC 1862. He reenlisted with Company K, 16th Missouri Cavalry, and served 'til war's end in 1865, leaving William Eldridge McAfee in the care of his wife's sister, Mary Lance. Spencer married Surilda Edney Denehew ( 13 Jan 1848, Indiana, 13 May 1912 Bergman, Boone County, Arkansas ) on 21 APR 1865. She bore 10 children :

Spencer McAfee lived in Fulton Co. AR with wife, Eveline Sparks in 1856. He married on Sept. 15, 1859 to Hannah Adeline Lance and then left for Missouri. He enlisted in Missouri in the Union army in Dec. 1861, and served in the 16 Regiment Missouri Cavalry; John McAfee and brother Spencer McAfee, Frank Lance, and his brother all joined to fight in the Civil War. Spencer joined Co. G, Phelps Regiment, Missouri Mounted Infantry, on 15 DEC. 1861 in Rolla Missouri. Spencer left the unit at time of Hannah's death in Rolla, MO, due to Measles, on 03, Dec. 1862. He reenlisted with Co. K, 16th Missouri Cavalry, and served til war's end in 1865 leaving William Eldridge Mcafee in the care of his wife's sister, Mary Lance. :

Harrison Times of Dec. 7th, 1912 -Spencer McAfee, aged eighty years and ten months passed from this world to the world beyond on Nov. 14th, 1912. He served in the Civil War, was a minister of of the gospel, a good citizen and loved by all those who knew him. He leaves a wife, three sons and three daughters to mourn his loss. He was laid to rest in the York Cemetery. Rev. John Carter conducted services.

Per another file of Ira Welker Miller b. Dec. 14, 1878 he had wife named Permillia Belle Dora MacAfee whom we believe to be our Amelia B. ( Belle ) McAfee but the date of birth for Permillia Belle MacAfee is given being Jan. 27, 1877 in Bergman, Boone Co. AR. More research is needed to clarify the name of this individual but we are going by our McAfee's records of census data and other court house files, which listed her as Amelia B. McAfee, as the name of AMELIA has passed on in the McAfee lines. I believe Amelia E. McAfee shown as age 3 on above 1880 Ozark Co. MO Census, may have been born closer to 1877 than to 1871 per Michael McAfee's files, however. - Tina Rogers Beller, May 15, 2007.

At this time it is not fully known if Mary Francis McAfee Weaver, McGuire, Shook had died in COLORADO or in ARKANSAS, and my feeling is that she may have moved back to ARKANSAS and died there in 1935. She is buried in the YORK CEMETERY, Boone Co. AR. - Tina Rogers Beller, May 02, 2006.

We have three different families of WEAVERS in our DAVIDSON families :

First Group of WEAVERS : HENRY WEAVER ( no dates of birth, death or marriage but presumed he married MARY FRANCIS McAFEE prior to 1889-1890 in AR. or MO ) No parents known for HENRY WEAVER and he is listed being born in NEWTON CO. AR on his daughters death certificate ( Edna Surilda Weaver b. Jan. 2, 1889-1890 is Henry Weavers child by Mary Francis McAfee. ) Henry Weaver said to have returned to OKLAHOMA ( Possibly to an INDIAN RESERVATION after the birth of his daughter in 1889-1890 ). Nothing more is known of HENRY WEAVER.

Second Group of WEAVERS : ISAAC W. WEAVER b. 1844 d. 1926 in Chester Co. TN md. SARAH JOSEPHINE DAVIDSON ( d/o HARVEY LOVE DAVIDSON and SARAH ANN HICKS of McNairy Co. TN. ). Harvey Love Davidson is the brother of SARAH DAVIDSON b. 1801 NC the mother of JAMES MONROE DAVIDSON b. 1825 Hickman Co. TN who lived and died in Boone Co. AR. Parents of ISAAC W. WEAVER are ISAAC WEAVER b. abt. 1819 NC or TN and wife ELIZABETH CHEEK. As we know PRUDY ANN ELKINS who md. JAMES MONROE DAVIDSON b. 1825 TN had parents JOSEPH ELKINS and SARAH CHEEK. Much misinformation on our Henry Weaver is in all our family files of the McAFee / Davidson families. At one time, it was thought HENRY WEAVER was HENRY O. WEAVER, a Cherokee or Creek Indian who left Mary Francis McAfee and their young daughter Edna Surilda Weaver with the McAfee family. Some of our families information included name of Henry O. Weaver as having married Mary Francis McAfee in 1887 in Henrietta, OK. and divorced Mary Francis McAfee on Sept. 18, 1888 but Edna Surilda Weaver wasn't yet born until 1889 or 1890. Using census data, I have listed that Edna Surilda Weaver was born in Jan. 1890 as shown on her step-fathers 1900 Newton Co. AR Census below : ( After the birth of Surilda E. Weaver, her mother Mary Francis McAFee then married Mat McGuire whose census data shows his step dau. Surilda E. Weaver living in his household in 1900 Newton Co. AR. )

My family files also show that Henry Weaver may have married Mary Francis McAfee about 1889, long after some had listed he had divorced her by 1888. Mary Francis McAfee has birth year of 1871 in Howell Co. MO so she would only have been age 17 in 1888, and 18 by 1889, but no location of this marriage or any marriage records have I found in their names so far. Also no known Divorce decree or papers are in my files of Henry O. Weaver or Henry Weaver and Mary Francis McAFee. So until we have further proof of Henry Weaver's verifications, it is hard to know what is accurate and inaccurate regarding this man. Family oral histories say he returned to Henrietta, OK. where he had supposedly married Mary Francis McAfee in 1887. These same family files had listed that Henry O. Weaver was a full blood Indian, but there is absolutely no proof so far of his verifications on any of these oral histories. In time, perhaps Native American researchers will have more regarding this man named HENRY or HENRY O. WEAVER. We have so far been unable to determine when Henry was born, much less where he lived, or when he married and divorced Mary Francis McAfee from my own work on this branch of our family. No one has yet shared any of the verifications if there are any, or court papers stating the facts listed in some of these oral histories, and until I see further proof of his marriage and divorce from Mary Francis McAfee, much of this information on Henry is sheer speculation on part of many of us. - Tina Rogers Beller, Jan. 07, 2007.

Surilda E. Weaver is step daughter to MAT McGUIRE of the 1900 Newton Co. AR Census. Her mother was MARY FRANCIS McAFEE WEAVER when she married MAT McGUIRE.

Shown in above census is Mary F. McQuire ( Mary Francis McAfee Weaver ) along with Edward G. McGuire the son of Mat McGuire and his first wife who was bron in KY as was Mat. Betty J. McGuire born Jan. 1900 is the daughter of Mat McGuire and 2nd wife, Mary Francis McAfee Weaver. Mat McQuire and Mary Francis McAfee divorced when Betty was about 4 years old per family oral histories. By 16th day of Nov., 1905, Mary Francis McAfee Weaver, McGuire then married JEROME SHOOK. They had two children named Jasper J. Shook born Jujly 26, 1906, AR. and Ella E. Shook born Feb. 27, 1909, AR. Mary Francis McAfee Weaver McGuire Shook died on March 05, 1935 and is buried in the York Cemetery, Boone Co. AR. near her parents Spencer Alvin McAFee and Surelda Jane Dunehew.

1. Homicide-Prosecution for Murder-Evidence Requiring Instruction on Manslaughter in First and Second Degree. Where the information charges one with murder, it is proper, and the duty of the court, where the facts justify, to instruct the jury upon the question of manslaughter in the first and second degree.

2. Indictment and Information--"Variance," When Material. A variance in a criminal case is an essential difference between the accusation and the proof, and a variance is not material unless it is such as might mislead the defense, or expose the defendant to the injury of being put twice in jeopardy for the same offense.

3. Homicide-Manslaughter in First Degree Perpetrated While Committing Misdemeanor-Intent to Kill Unnecessary. Oklahoma Statutes 1931, § 2223, 21 Okla. St. Ann. § 711, defines manslaughter in the first degree as, "1. When perpetrated without a design to effect death by a person while engaged in the commission of a misdemeanor." Under this section it is not necessary that defendant intended to kill deceased.

BAREFOOT, J. Defendant, Roy Hodges, and C. F. Daley were charged jointly with the crime of murder. A severance was had and defendant was tried separately, convicted of manslaughter in the first degree, and sentenced to serve seven years in the penitentiary, and has appealed.

The charging part of the information was as follows: "did beat and strike the said Jasper B. McAfee on and about the head and body, then and there and thereby inflict upon the body and head of said Jasper B. McAfee by beating and striking, as aforesaid, certain mortal injuries of which mortal injuries so inflicted, as aforesaid, the said Jasper B. McAfee did instantly die, as was intended by said defendant."

It is contended by defendant: (a) That the evidence revealed that deceased died because of a broken neck, and that therefore there was a fatal variance between the proof and the allegations contained in the information; (b) that there is absolutely no evidence that deceased died from the effect of striking, beating, bruising, or blows upon the body and head, as charged in the information as being mortal wounds.

The evidence as shown by the record was that a man by the name of Fred Ward was an oil field worker in Capitol Hill, Oklahoma City. That on the 9th day of September, 1936, one R. C. Smith, who was a friend of his, came to his home. That soon thereafter they went to the business district of Capitol Hill, where he left some shoes to be repaired. They went to a resort to get a bottle of beer, and there met C. F. Daley, whom Mr. Smith knew. About 4 o'clock they again met Mr. Daley and Roy Hodges, the defendant, whom Mr. Smith knew and was wanting to see, with reference to helping him to find work in the Capitol Hill oil field. The four parties, to wit, Ward, Hodges, Daley and Smith, got in Hodges' car and drove out southwest of Capitol Hill. While out there they all took a drink of whisky from a bottle belonging to defendant, and which contained about one-fourth of a pint. They returned to a barbecue stand, located at 3319 South Robinson Avenue, arriving there about 6:30 p. m. They all got out of the car and seated themselves at one of the tables on the outside and drank several bottles of beer. While they were seated there an elderly man named Jasper B. McAfee, about

60 years of age, and weighing about 130 pounds, came up and seated himself at a table just north of the parties named. He was sitting on a bench leaning his head on the table when one of the parties, C. F. Daley, went to where he was and turned over the bench on which Mr. McAfee was sitting. There was no cause for this, and Mr. McAfee got up and laid down on the bench. It was but a few minutes until the defendant, Roy Hodges, went over and pushed the bench over and Mr. McAfee again fell to the ground. When he got up he came over to the table where the others were sitting and protested about being interfered with, saying: "I am an old man and I try to be all right, and I don't like to be treated this way." He never at any time made any demonstration in any way toward defendant or any of the parties, and the witness Fred Ward spoke to defendant, saying: "I told him to leave him alone, he was an old man and wasn't bothering anybody." About this time a young man named Jack Adair, who worked at the barbecue stand, came up, and defendant slapped Mr. McAfee with his hand and knocked him up against a post, and he staggered and fell against the ground. The witness Jack Adair asked defendant not to have any trouble, and defendant told him to go on "or he would whip hell out of me," to which witness replied: "If I can't handle you I will get some one that can." And he started toward the car, defendant following him, and he got off the fender of the car and knocked defendant down. The deceased was picked up and laid on the bench, and was afterwards taken away in an ambulance. He died as a result of being struck by defendant. An examination by the undertaker and an interne revealed that his neck was broken, and this was the immediate cause of his death. All of the parties left the scene of the difficulty. The defendant was found the next morning at the home of a friend near Britton, north of Oklahoma City. His car was found in the woods some distance from the house. The witnesses R. C. Smith and Fred Ward did not learn of the death of deceased until the next morning when they saw an account in the news

papers, and they immediately reported to the officers, and were witnesses in this case. The defendant did not testify.

The above statement is necessary in order to consider the question of variance between the allegations of the information and the evidence in the case. It will be noted that defendant was convicted of manslaughter in the first degree. The court, in his instructions, properly eliminated the question of murder, and only submitted manslaughter in the first degree and second degree. The statute defining manslaughter in the first degree, Oklahoma Statutes 1931, § 2223, 21 Okla. St. Ann. § 711, provides:

"Homicide is manslaughter in the first degree in the following cases:

"1. When perpetrated without a design to effect death by a person while engaged in the commission of a misdemeanor.

"2. When perpetrated without a design to effect death, and in a heat of passion, but in a cruel and unusual manner, or by means of a dangerous weapon; unless it is committed under such circumstances as constitute excusable or justifiable homicide.

"3. When perpetrated unnecessarily either while resisting an attempt by the person killed to commit a crime, or after such attempt shall have failed."

It has been universally held by this court that the charging of the greater degree includes all of the lower degrees of the same crime. Jones v. Territory, 4 Okla. 45, 43 P. 1072; Rhea v. Territory, 3 Okla. Cr. 230, 105 P. 314; Byars v. State, 7 Okla. Cr. 650, 126 P. 252.

The defendant was charged with the crime of murder. It was not only proper, but the duty of the court, under the facts, to submit to the jury the question of manslaughter in the first and second degree. The evidence revealed that deceased was killed by defendant while engaged in the commission of a misdemeanor, as clearly defined by section 1 of the above quoted statute. There was no action on

the part of deceased which showed any aggression on his part. He mildly protested when he was thrown from the bench by defendant, and when he did so defendant immediately hit him in the face, and knocked him against a post, and he fell to the ground, and as a result of this his neck was broken and he died. There is nothing in the evidence to show that defendant intended to kill deceased. He did not know him, and there was no cause to strike him. It seemed to be defendant's idea of having fun, and especially when he was evidently under the influence of liquor. But the law does not sanction fun of this character for it says a person is legally responsible for the natural and necessary consequences of his own unlawful act, and under the statute of which defendant was convicted, it is not necessary that he should have intended the death of deceased. Tyner v. U. S., 2 Okla. Cr. 689, 103 P. 1057.

Defendant relies upon the case of Elliott v. State, 4 Okla. Cr. 224, 111 P. 820, 140 Am. St. Rep. 683, for a reversal of this case. While we think there is a clear distinction between this case and the case at bar, this court in the case of Tiger v. State, 54 Okla. Cr. 202, 16 P.2d 889, had occasion to refer to the Elliott Case, and while the same was not overruled, the doctrine as announced therein was not followed, and it is our opinion that the reasoning in the Tiger Case is more sound, and is in accord with the modern and better reasoned cases. The court, in that case, said:

"The only contention made is that the testimony does not sustain the charge; that, while there is testimony that defendant struck Kelly with his fists and knocked him down against the stove and that some time in the fight kicked him, there is no proof of the allegation of an assault with a heavy, dangerous, blunt instrument. Defendant relies for a reversal on the case of Elliott v. State, 4 Okla. Cr. 224, 111 P. 820, 140 Am. St. Rep. 683. It is not contested that Kelly met his death in a fight with defendant; that death was caused either by defendant striking deceased with his fist, causing him to fall and sustain the

wounds from which he died, or by kicking him and causing the wounds, or by striking him with some weapon not disclosed. As to the cause of death, the physician who performed the autopsy testified deceased had been struck with some blunt instrument; that in his opinion the injuries on the face could not have been caused by a rubber-heeled shoe.

"The only question then is, Is there a fatal variance between the charge and the evidence? The courts of several of the states have gone to an extreme length in holding a variance fatal. Some of these opinions have reversed cases on a variance on some point or some purely technical matter which by the later and better reasoned cases and the more modern rule would be brushed aside as immaterial. This court has followed the later sensible rule as stated in Woods v. State, 22 Okla. Cr. 365, 211 P. 519, and again asserted in Brashears et al. v. State, 38 Okla. Cr. 175, 259 P. 665. These later cases define a variance as an essential difference between the accusation and the proof and that a material variance arises only when there is such a difference between the proof and the charge that an acquittal of the defendant would be no bar to a further prosecution for the same offense. The charge that deceased met his death by wounds inflicted by a blunt instrument is sustained by the proof. It is evident that the county attorney did not at the time of filing the charge or at any subsequent time know what instrument was used. The proof very strongly indicates that deceased was knocked down and kicked in the head by defendant, which kicks caused the fractures of the skull testified to. If defendant has been acquitted under this charge, he certainly could not have been again prosecuted for causing the death of deceased in some other manner."

As stated in that case it is certain that the defendant was in no way misled by the charge in the information in this case. There is no question but that the striking of deceased by the defendant was the direct cause of his death, even though it does not reveal whether the broken neck was the result of the striking, or the fall against the post or falling to the ground. There is no question but that a conviction or acquittal of defendant would be a bar to a further prosecution for this offense, Gaunce v, State,

22 Okla. Cr. 361, 211 P. 517; Lady v. State, 18 Okla. Cr. 59, 192 P. 699; Higdon v. State, 58 Okla. Cr. 224, 52 P.2d 103; Woods v. State, 22 Okla. Cr. 365, 211 P. 519; Kercheval v. U. S., 5 Cr., 36 F. 2d 766; Tiger v. State, 54 Okla. Cr. 202, 16 P.2d 889.

It is unfortunate that death resulted when there was no design upon the part of the defendant to effect death, but the statute provides that it is manslaughter in the first degree "when perpetrated without a design to effect death by a person while engaged in the commission of a misdemeanor."

Finding no error in the trial of this case, we are of the opinion that the judgment of the district court of Oklahoma county should be affirmed and it is so ordered.

"On Saturday, the 5th of December, 1908 she noted "Bass Davidson of Mt. Hersey, and Edna Weaver of Keener were married at the home of R.L. Derryberry,recently, left for Harrison immediately."
Per Ella Davidson McWherter files and the 1930 Depression in Arkansas. :

According to Ella Davidson McWherter files, her father, Samuel Bascum
Davidson, lost his job during the 1930 Depression and then worked cutting
wood and making railroad ties to sell for income. The children were left
alone during this time, as their mother had died Sept. 1930, and Sam was
working hard to keep the family together after his wife's death. The
young daughters worked at the Canning factory taking along their younger
brothers so they could care for them there. The period of 1930 was a
difficult time for everyone in America then, and the Davidson family were no
exception. Samuel Bascum Davidson was gone so much of the time trying to
eek out a living for his young family, and his father JAMES MILTON
DAVIDSON was said to have stayed with Sam's children. James Milton
Davidson's wife Miranda Clementine Matlock Davidson also died in May 1927,
at Searcy Co. AR., so I am sure he sought comfort in being able to help out
his son and grandchildren. I am sure that Sam was appreciative of the help of
his father James Milton Davidson, during these difficult times. ( James
Milton Davidson had lived alone and offered to stay with the children while
Sam was away. ) As Edna Surelda Weaver Davidson had also died by 1930, Sam
was lucky to have his father there with his children.

Ella also stated that her Grandpa ( James Milton ) had a sister who owned a
hotel in Pindall, Searcy Co. AR. The business was not doing well and so
she moved to Oklahoma where her husband had acquired a job. Since she
couldn't sell the hotel in Pindall she asked that Samuel Bascum Davidson (
her nephew ) move into the hotel with his young children so that at least
the hotel would be occupied, and the children would be out of the house
where their mom Edna Surelda Weaver Davidson had died in 1930. The
children were alone at night in the hotel and were frightened and missing
their mother and grandfather who both had died, and with their father gone
at night, it was a very sad time in their lives. ( These were small
children trying to cope with life the best they could under these dire
circumstances. ) Eventually, Ella married and moved away. Ella's older
brother, Raymond Davidson and his wife then helped to care for the younger
brothers, Jack and Archie Dale Davidson. Meanwhile, Samuel Bascum
Davidson was aggravated with his young daughter, Ella, for having married
and for leaving the family unit, but eventually forgave her. Ella, at
least had the chance to make a good life for herself and her husband and
family Ella and her husband bought 40 acres of land between Pindall and
Western Grove AR with a one room LOG CABIN to start their married life.
If not for the written oral history of Ella Davidson McWherter we would have
lost the essentials of the daily life of Samuel Bascum Davidson and his
younger children who still remained in his home, during this time period of
1927-1931. Ella's daughters thought enough of this famiy history to share
it with us all, for which I am deeply grateful. - Tina Rogers Beller, Jan.

At this time it is not fully known if Mary Francis McAfee Weaver, McGuire, Shook had died in COLORADO or in ARKANSAS, and my feeling is that she may have moved back to ARKANSAS and died there in 1935. She is buried in the YORK CEMETERY, Boone Co. AR. - Tina Rogers Beller, May 02, 2006.

Edward Garvin Ply, 72, died Tuesday, Jan. 23rd, 2001 at his home in Syracuse.
He was bn 3-29-1928 in Olathe, Co. The son of Floyd Ply and Ella Shook. He attended Syracuse Schools and received his GED certificate while serving in the Air Force.

A Syracuse resident for more than 50 years, he retired in 1993 as an equipment operator for the Hamilton Co. Road Dept.

He is survived by his life mate of 26 years, Maxine J. Ralstin of Syracuse; two daughters, Melinda Ply, Pensacola, Fla. and Michelle Baier of Guttenburg, Iowa. A sister-in-law Vivian Ply of Lamar, Co. He was preceded in death by his mother Ella (Shook) Conley, his step father Vernon Conley, a brother Duane Ply and a sister Mary Frances Robertson.

There will be no service, cremation has taken place.

Ernest Rogers served as Sheriff of Boone Co. AR from 1932 to 1938. Oscar Rogers was his deputy sheriff during that tenure. Oscar Rogers was the son of Basil Alexander Rogers b. 1849 in Carroll Co. TN and Sarah Gilmore; Ernest Rogers was the son of William Manuel Rogers b. 1857 in Carroll Co. TN and Ophelia Ann Richesin. Basil Alexader Rogers and William Manuel Rogers were brothers, thus Ernest Rogers and Oscar Rogers were first cousins.

The Paternal Grandparents of Ernest Rogers were, Green D. Berry Rogers & Sidy ( Sidney ) Fields of Carroll Co. TN who moved to Boone Co. AR in about 1870 from Carroll Co. TN. ( The parents of both Basil Alexander Rogers and William Manuel Rogers were GREEN D. BERRY ROGERS, and wife SIDY ( SIDNEY ) FIELDS ROGERS. ) The maternal grandparents of Ernest Rogers were Thomas Hasque Richesin and Melinda E. Murray also of Boone Co. AR. Thomas Hasque Richesin purchased his first Arkansas farm from John Poplin and 2nd wife Mahala Breece. John Poplin then married 3'rd wife Minerva Jane Hinson Curry after the death of Mahala Breece. Minerva Jane Hinson was the first cousin twice removed to Ernest Rogers 2nd wife ELSIE B. DAVIDSON.

Green D. Berry Rogers purchased land in Boone Co. AR from the Leeper family in Dec. 1870, Green D. Berry's brothers, James Franklin Rogers b. 1831 TN; Basil Jasper Rogers b. 1830 TN and their spouses and children; along with Purity Drucilla Rogers b. abt. 1832 TN the sister of Green D. Berry Rogers and his brothers, moved to Boone Co. AR later on it is believed. Purity Drucilla Rogers married Silas Acuff in Boone Co. AR and is buried with him in same grave, in same county.

Another sister of these 4 Rogers siblings is said to have been Nancy Martin Rogers whose gravesite is said to have been in Bellefonte Cemetery near her brother Green D. Berry Rogers and sister - in - law, Sidy Fields Rogers, gravesites. However, perhaps Nancy Martin Rogers grave is unmarked or with only a field stone to mark her gravesite, for we have not found her buried in Bellefonte Cemetery in Boone Co. AR. from their gravesite listings either. It also might be that Nancy Martin Rogers had married in Carroll Co. TN and is buried there; no further information on Nancy Martin Rogers . - Tina Rogers Beller, 2004.
